Supervisor Liability

Course Overview:

Supervisors take on more the responsibility for overseeing the operations of their areas. They often take on greater potential liability for lawsuits and other legal actions.

In this course, police supervisors will learn to understand what types of police behavior will most likely spawn lawsuits. Participants will learn how to make sound hiring decisions, document and discipline officers for misconduct, and ensure adequate training. They’ll explore the role of leadership in reducing liability and protecting the agency from lawsuits. Participants will review real-life cases and video to enhance understanding and practical application of the legal concepts being discussed.

Upon Completion:
Participants will be able to:

• Describe the potential impact of 1983 actions
• Make sound hiring decisions
• Legally screen out unfit applicants
• Avoid negligent retention of problem officers
• Identify officer behaviors that subject departments to liability
• Discourage sexual harassment
• Use performance appraisals to establish the right to discipline or dismiss officers
• Handle workplace issues related to injured or disabled officers
• Document performance and discipline officers for misconduct
• Understand the importance of proper officer training
• Identify leadership behaviors that reduce liability
• Avoid actions that can lead to retaliation
• Detail what constitutes a hostile work environment
• Deal more effectively with “gypsy” cops who switch departments to escape trouble
