Legal and Liability Issues In Schools for Teachers, Students and School Resource Officers

Course Overview:

America’s schools face a difficult balance of protecting students’ freedom and rights while assuring their physical safety. High-profile incidents of school violence place communities on edge, and teachers and school resource officers are placed in the position of having to ensure students’ security without violating a confusing array of rights.

This course provides an overview of the impact of school violence on student rights and an exploration of the practical impacts of a long list of court cases involving students and school employees. Participants will review a variety of issues and associated legal challenges, acquire strategies for ensuring student safety, and develop a sound framework for policy development.

Upon Completion:
Participants will be able to:

• Describe the shifting legal requirements that have resulted from school violence
• Gain an understanding of the law relating to searches in and around school property
• Discuss the legal differences of searches conducted by teachers and those conducted by law enforcement
• Identify the legal issues surrounding the use of video and audio surveillance
• Explain Constitutional rulings regarding drug testing of students
• Gain working knowledge of laws relating to student interviews/interrogations for disciplinary matters
• Detail current law related to use of physical force to control and punish students
• Understand legal duties and obligations with respect to protecting students
• Recognize obligations of teachers and school officials to report various crimes that they become aware of through contact with students
• Become familiar with students’ First Amendment rights
• Understand legal issues regarding use and censorship of students’ use of the internet
• Explain student confidentiality rights will respect to discipline and schoolwork
• Discuss law relating to school-requested mental health evaluations of students
