Only three ways into a Home: Consent; Exigency; Warrant

Exigency

Minnesota v. Olson, 495 U.S. 91 (1990)

Illinois v. MacArthur, 531 U.S. 326 (2001)

Brigham City, UT v. Stuart U.S. 1943 (2006)

Can Officer Articulate Exigency?

* Hot Pursuit of Fleeing Felon
* Imminent Destruction of Evidence that relates to a Jailable Offense
* Need to Prevent Suspect’s Escape
* Risk of Danger to Police or Others-Either Inside or Outside the Dwelling
* Danger of Serious Injury or Death encompasses police conduct beyond criminal investigations i.e. well-being checks.
* Once Exigency has Passed, any further intrusion would require consent or a warrant.
* There is no automatic-exigency at crime scenes-Unless police can articulate on-going exigency, a search warrant must be obtained prior to crime scene searches for evidence.
