Schools and Juveniles Students Do Not Leave All Constitutional Rights At the School House Gate
Speech and Expression: Student may be disciplined if:
- School can establish that speech or expression disrupted the school environment. Actual disruption must be articulated. Tinker v. Des Moines, 393 US 503 (1969)
- Speech and Expression that is highly offensive and vulgar may be controlled in the school setting. Bethel v. Frazier, 478 US 685 (1986)
- Schools can restrict speech or expressive conduct where the speech or conduct is clearly contrary to the basic educational mission of education. Hazelwood School District v. Kuhlmeier, 484 US 260 (1988)
